What are WE doing here?
In order to answer that question, we have to take you back to that afternoon years ago, when you were in that stuffy, smelly organic lab, struggling to make a few grains of ASA in order to keep your grades high enough to get into medical school. During those years, the same people who want to regulate you out of business were gleefully traveling with backpacks around Europe. OK some of them were in law school. But most had it way easier than you did. Now, they want to take everything away from you.
Our Nation’s Founders Understood
They were not naïve people. When they rebelled against the English Crown, they knew full well that Government would just as soon HANG them. So people need the most protection possible from Government. This was the birth of our Constitution.
Physicians are Not Protected by the Constitution
As a physician you have NO Constitutional right to practice medicine. This makes you vulnerable to almost any charge the Government hangs against you. Senator Ron Wyden (Dem OR) implanted the National Practitioner Data Bank to control physicians (1986). This marked the beginning of the war against doctors. If there was ever a definition of a “legal orgy” the ever-expanding laws regulating healthcare continued unabated. Even better if you are “unaware” of them.
Can’t I Sue?
You cannot sue anyone or any Board to practice medicine. You have no Constitutional protection for this.
The Best Solution: Birth of the “Prospective Defense
There are two types of people. Those who plan to protect themselves and those who don’t. We don’t blame those who, for reasons of simple exhaustion, chose not to defend themselves. But they may well pay the ultimate price. Regulators are not your friends. They expand their control by bringing you down.
We are all about Prospective Defense
- Acknowledge the areas of risk Government has placed against you.
- Hire people who can set up a defense you can use BEFORE Government auditors appear at your doorstep. Present your completely executed plan to them and then kick their asses out.
- Government penalties are mostly financial but can also stretch into notification of the National Practitioner Data Base against you.
